Kanun Tanah Negara is a fundamental and sovereign document, that reflects the thoughts and goals of the first constitutional government of the Republic of Indonesia, proclaimed on 19 August 1945 and still functions as the basis of all other existing and future constitutional documents in Indonesia.
The Kanun is the constitutive law of the Republic of Indonesia. Although it is formally titled "The Supreme Law of the Republic of Indonesia", it is not in the form of a constitution. The Kanun specifies the parameters of the government, as well as the relationships between people and institutions of the country. The Kanun is the highest law of the republic, and the supreme law of all existing and future constitutions of the country.
The supreme law was proposed and approved on 3 October 1945 by the First and Second Majlis, and is known as the I / II Majlis Penanggulangan Tanah Negara, since it is the reconciliation of the Istiadat (Independence) and 1st Majlis of the Third Constitutional Assembly of the Republic of Indonesia. The ratification of the final draft of the Kanun by President Sukarno of the Republic of Indonesia on 1 January 1965 was a critical step in the process of the abolishment of the Dutch colonial rule.
When Sukarno was elected president of the Republic of Indonesia for the first time, the Dutch colonial rule was no longer so complicated, and the new president did not have to negotiate with the Dutch colonial government as much as other leaders did. He also felt that the Dutch colonial government could not be trusted anymore, so he decided to move to a policy of Indonesian independence.
Although the Dutch colonial government was already prepared to cede the territory of the former Dutch East Indies, it did not want to give up the whole colony, so it immediately responded by the declaration of the Pacific War.
